Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Hausee platform, including the Hausee website, the Home Buyers Playbook, the Financial Readiness Masterclass, Brix (our home buying assistant), Hausee Select, and any other products or services offered by Hausee ("Hausee," "we," "us," or "our") (collectively, the "Services").

These Terms apply to home buyers, home sellers, and all other visitors and users of the Services ("you" or "User"). If you are a real estate professional or service provider participating in the Hausee Partner Agent Network, your relationship with Hausee is instead governed by the Hausee Partner Agent Terms and Conditions, available at hausee.ca/terms.

By accessing or using the Services, creating an account, or clicking "I agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at hausee.ca/privacy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.

You must be at least the age of majority in your province or territory of residence and legally capable of entering into a binding contract to use the Services.

Hausee provides educational content, planning tools, and a marketplace intended to help Canadians, particularly first-time home buyers, navigate the home buying and ownership journey. The Services currently include, without limitation:

• Financial Readiness Masterclass – educational content to help you assess and prepare financially for home ownership.
• Home Buyers Playbook – self-directed educational resources covering the home buying process.
• Brix – an AI-powered assistant that answers questions and provides general information to support your home buying decisions.
• Hausee Select – a marketplace that connects you with real estate agents who compete to earn your business, as described in Section 6 below.

Hausee may add, modify, suspend, or discontinue any part of the Services at any time, with or without notice, and without liability to you.

Certain Services require you to create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at sayhello@hausee.ca if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate any account that provides false information, violates these Terms, or is used in a manner that could harm Hausee, other Users, or Partner Agents.

Hausee's educational content, tools, calculators, simulators, the Home Buyers Playbook, the Financial Readiness Masterclass, and Brix are provided for general informational and educational purposes only. They are not, and should not be relied upon as, financial, legal, tax, insurance, mortgage, or real estate advice specific to your circumstances.

You should consult a licensed mortgage professional, financial advisor, real estate lawyer, or other qualified professional before making financial or legal decisions related to buying, selling, financing, or insuring a home.

Tools such as affordability calculators, budgeting tools, and planning features rely on the information and assumptions you input, together with general market data that may not reflect your specific circumstances or current conditions. Results are estimates only. Hausee makes no representation or warranty that any estimate, projection, or output reflects what you will actually qualify for, afford, or be offered by any lender, insurer, or other third party.

Hausee Select is a marketplace that allows you to describe your home buying or selling needs and receive competing offers from Partner Agents in the Hausee Agent Partner Network. By using Hausee Select, you understand and agree to the following:

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Provide false, misleading, or fraudulent information, including when describing yourself as a motivated buyer or seller;
• Attempt to circumvent Hausee Select to solicit or transact directly with a Partner Agent in a manner intended to avoid applicable referral fees, where you are aware such fees apply to the agent;
• Scrape, copy, or reproduce Hausee's educational content, tools, or platform for commercial redistribution;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
• Use the Services to harass, defame, or harm any other User or Partner Agent.

The Services, including all text, graphics, tools, calculators, the Home Buyers Playbook, Brix, software, and the Hausee name, logo, and branding, are owned by or licensed to Hausee and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services without Hausee's prior written consent.

You retain ownership of any information you submit to Hausee ("User Content"). By submitting User Content, you grant Hausee a non-exclusive, royalty-free, worldwide license to use, reproduce, and share that content as reasonably necessary to provide the Services, including sharing relevant information with Partner Agents through Hausee Select, subject to our Privacy Policy.

The Services may contain links to, or integrate with, third-party websites, tools, or service providers, including Partner Agents, lenders, insurers, or other service providers. Hausee does not control and is not responsible for the content, policies, or practices of any third party. Your use of any third-party service is at your own risk and subject to that third party's own terms.

Hausee does not guarantee that the Services will be uninterrupted, secure, or error-free, that any educational content or tool output is accurate or current, or that any Partner Agent introduction will result in a successful transaction or satisfactory outcome. Nothing in this section limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

To the maximum extent permitted by applicable law, Hausee, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or opportunity, arising out of or related to your use of the Services, including any transaction, decision, or outcome involving a Partner Agent, lender, insurer, or other third party.

To the extent permitted by applicable law, Hausee's total aggregate liability to you for any and all claims arising out of or relating to the Services will not exceed CAD $500. This cap applies regardless of the number of claims or the legal theory under which liability is asserted (contract, tort, statute, or otherwise), and does not limit any liability that cannot be excluded or limited under applicable Ontario or federal law, including as set out in Section 10.

You agree to indemnify and hold harmless Hausee and its officers, directors, employees, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Services, or your interactions with any Partner Agent or other third party introduced through the Services.

You may stop using the Services and close your account at any time. Hausee may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, provided false information, or engaged in conduct that harms Hausee, other Users, or Partner Agents. Sections of these Terms that by their nature should survive termination – including Sections 4, 8, 10, 11, 12, and 15 – will survive.

Hausee may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a revised "Last updated" date and, where appropriate, provide additional notice (such as an in-app or email notice). Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Ontario, and you consent to the jurisdiction of such courts.

• Entire Agreement: These Terms, together with the Privacy Policy and, where applicable, the Hausee Partner Agent Terms and Conditions, constitute the entire agreement between you and Hausee regarding the Services.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Hausee's failure to enforce any provision of these Terms is not a waiver of that provision.
• Assignment: You may not assign these Terms without Hausee's prior written consent. Hausee may assign these Terms in connection with a merger, acquisition, or sale of assets.
